b) Use the services in a way that could damage, disable, overburden or impair any HeyCody server, or the network(s) connected to any HeyCody server, or interfere with any other party’s use and enjoyment of any services;

c) Attempt to gain unauthorized access to any services, other accounts, computer systems or networks connected to any HeyCody server or to any of the services, through hacking, password mining or any other means;

d) Obtain or attempt to obtain any materials or information through any means not intentionally made available through the services;

e) Use the services in a manner that negatively affects other users’ ability to use the services;

f) Use the services to harm minors in any way; and

g) Use the services to impersonate any person or entity, or otherwise misrepresent your affiliation with a person or entity.

Violation of any of the above can result in immediate termination of this Agreement, and may subject you to state and federal penalties and other legal consequences.

5. Intellectual Property Rights

All materials on HeyCody, including, without limitation, names, logos, trademarks, images, text, articles, graphics, photographs, illustrations, artwork, software and other elements are protected by copyrights, trademarks and/or other intellectual property rights owned and controlled by HeyCody or by third parties.

6. Indemnity

You agree to indemnify and hold harmless HeyCody, its affiliates, officers, directors, employees, agents, and licensors from against any and all claims, costs, damages, losses, liabilities, and expenses arising out of or in connection with: a) your use of the service; b) your violation of these terms; c) your violation of any third party right, including without limitation any copyright, property, or privacy right.

7. Governing Law

These Terms of Use and any action related thereto will be governed by the laws of Victoria, Australia without regard to its conflict of laws provisions.

8. Changes to Terms of Use

HeyCody reserves the right, at its sole discretion, to modify or replace any of these Terms of Use, or change, suspend, or discontinue the service at any time by posting a notice on the site or by sending you a notice through the service, via e-mail or by another appropriate means of electronic communication.
